Terms and Conditions for Baila Vancouver Dance Inc. and Nina Perez Enterprises

Welcome to Baila Vancouver Dance Inc. ("we," "our," "us") dba DanceToday.Fun. and Nina Perez Enterprises dba Connect To Thrive. By registering and  participating in our classes, workshops, coaching programs and events, you agree to the following terms and conditions. Please read them carefully to ensure a mutual understanding of our policies and your responsibilities.


1. Assumption of Risk and Release of Liability for DanceToday.Fun

1.1 Acknowledgment of Physical Activity: I understand that participating in dance and fitness classes involves physical exertion, which may be strenuous and could result in physical injury. I acknowledge that I am fully aware of the risks and hazards involved.

1.2 Medical Clearance: I agree to consult a physician prior to participating in any class or activity at Baila Vancouver Dance Inc. I represent that I am physically fit and have no psychological, medical, or emotional condition that would prevent my full participation.

1.3 Assumption of Responsibility: I accept full responsibility for any risks, injuries, or damages, known or unknown, that I may incur as a result of participating in classes, workshops, or events at Baila Vancouver Dance Inc.

1.4 Waiver of Claims: I knowingly and voluntarily waive any claims against Baila Vancouver Dance Inc., Dance Today, their instructors, assistants, or staff for any injury, loss, or damage I may sustain as a result of participating in activities.


2. Coaching Programs Terms for Connect To Thrive

Yanina Perez - Nina Perez Enterprises provides online and in person education, empowerment, and community to people around the world.

The purpose of the programs is to develop a coaching relationship between the Parties in order to cultivate the Client’s personal, professional, and/or business goals and to go through the curriculum, so the client can create a plan to carry out those goals. The coaching will create stimulating and creative interactions with the ultimate result of maximizing the Client’s personal and/or professional potential (“Coaching Services”).

A Connection coaching relationship is a partnership between two individuals. This relationship is not a legal partnership, instead more like a teacher-student or coach-athlete relationship. Each Party must uphold its obligations for the coaching relationship to be successful.

2.1 Program Fees. The amount paid by the client is  agreed upon in the email sent with the custom details of the program and payment links. Making payment is the affirmation action that these terms and services were reviewed and agreed upon. Rates are subject to change upon renewal.

2.2 Cancellation Policy. The Client agrees to notify the Coach 24 hours in advance of any scheduled session that the  Client needs to cancel. The Coach reserves the right to charge the Client for the scheduled session for a missed/canceled meeting.

Client and coach shall have the option to terminate this Agreement at any time by providing at least 30 days written notice. No refunds will be issued if termination is initiated by the client. 

2.3 Code of Conduct 

The Client will:

  • Communicate honestly, be open to feedback and suggestions, and to fully engage and devote oneself to the coaching process. (Open mind, open heart, and open will)
  • Acknowledges and agrees that coaching is a comprehensive process that may explore different areas of the Client’s life, including work, and relationships, but it is ultimately the Client’s decision how the Client incorporates coaching into each aspect of life.
  • Acknowledge that the client is solely responsible for implementing the techniques discovered through coaching and through doing the homework will be able to apply in other areas of life.
  • Not share logins to portals as passwords and files, as they are solely for the client’s use in their learning journey. If Client shares their login information, passwords, with any other person, the Client’s access will be terminated immediately. Yanina Perez- Nina Perez Enterprises reserves the right to pursue legal action. 

The Coach will:

  • Maintain the ethics and standards of behaviour of a professional service. 
  • Teach the curriculum of connection coaching and provide access to relevant content.
  • Provide access to the portal with replays until the coaching agreement ends.
  • Be present to the best of her ability and provide coaching support.
  • Answer text or emails from the client within 48 hrs.

2. 4 Limitation on Services. Client understands and agrees that the Coach’s services are not counselling services and are not a substitute for professional counselling by a licensed psychotherapist or other licensed professional. Client understands the Coach is not providing counselling, healthcare, mental health advice, or the diagnosis or treatment of a condition or illness. 

Client also understands and agrees that the Coach’s services are not specific financial or medical advice and Company cannot guarantee any specific outcomes.

Client understands that the scope of services provided by Coach only includes those services particularly described in this agreement. The limitations listed are not meant to be a comprehensive list of all limitations and that in addition to the limitations set forth above that the only services to be provided are those set forth in this agreement. 

Client agrees and acknowledges that Client is fully responsible for their own health and for self-managing any risks that may occur from following the recommendations contained in the coaching. The Client recognizes their responsibility to consult with appropriate professionals for appropriate care of their medical, psychological or financial needs.

The Coach makes no guarantees, representations, or warranties of any kind or nature, expressed, or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential, or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date. 

The Client agrees that the Coach is not liable or responsible for any actions or inactions, or for any direct or indirect result of any services provided by the Coach.

If client is currently under the care of a licensed therapist professional, this program is not a substitute or replacement for that program of care. The Client has the responsibility to seek mental health advice before starting our coaching.  If the client has a mental health emergency or a past trauma trigger, client has the responsibility to see a licensed therapist to help heal that condition. 

2.5 Coaching Confidentiality. The one-on-one sessions between the client and the coach are confidential. The Coach-Client relationship is not a relationship protected by legal confidentiality (like doctor-patient or attorney-client). As such, the Coach could be required to divulge otherwise confidential information to authorities.

Client acknowledges that it may be necessary for the Coach to disclose confidential information to a third party for the following reasons:

  • If the client expresses the wish to harm themselves or others. 
  • To design practice sessions for the benefit of the client.

The confidentiality does not extend to any group or recorded materials. The group sessions and practices are not confidential, and all recorded material can and will be used for future trainings and watched by future students

Client acknowledges that participating in these sessions is akin to speaking in a public group setting, therefore waives any claim to confidentiality.

3. Photo and Video Release

3.1 Permission to Use Likeness: By participating in our classes or events,  Baila Vancouver Dance Inc. dba DanceToday.Fun and any of our group coaching program group calls, you are giving us express permission to take and use photos or videos of my likeness in promotional materials, social media, website content, testimonials, and advertising. This usage is royalty-free and perpetual, and you waive any rights to inspect or approve the final materials.


4. Membership and Class Policies

3.1 Non-Refundable Purchases: All memberships, class cards, and promotional offers are non-refundable.

3.2.  Schedule Changes: Class schedules are subject to change without notice. We will make every effort to inform participants of any adjustments.

3.3 Class Cancellations:

  • If a participant registers and pays for a class, whether as a drop-in or using a class card (e.g., 3-pack or 4-pack), and cancels less than 4 hours before the scheduled class time, they will be charged for that class.


4. Pricing Policy

4.1 Price Changes: All prices for classes, memberships, workshops, and events are subject to change without prior notice. The price at the time of purchase will remain valid for that transaction.


5. Online Courses

5.1 Access Period: Access to online courses is valid only for the time period specified at the time of purchase.

5.2 Prohibition on Sharing: Participants are not permitted to share their login credentials or access to the online portal with any other individual. Any breach of this policy may result in the immediate removal of access without a refund.

5.3 Non-Refundable Policy: All online course purchases are non-refundable.


6. Participant Conduct

6.1 Respectful Behavior: Participants are expected to conduct themselves respectfully toward instructors, staff, and fellow students. Disruptive or inappropriate behavior may result in removal from the class or termination of membership without refund.

6.2 Compliance with Policies: Participants must adhere to all studio policies, including health and safety guidelines, as communicated by Baila Vancouver Dance Inc.

6.3 No Filming Policy: Filming during classes is strictly prohibited unless expressly authorized by the instructor or staff.


7. Copyright and Intellectual Property

7.1 Copyright: All choreography, videos, and instructional materials are the intellectual property of Baila Vancouver Dance Inc. Participants may not copy, share, or reproduce these materials without prior written consent. All Training programs conducted by Nina Perez and her Coaching Programs are intellectual property and may not be shared without express written consent prior to usage. 

7.2 Exception for Wedding Couples: Wedding couples may film and share their wedding dance provided that Baila Vancouver Dance Inc. (DanceToday.fun) is credited appropriately in the post or media.


8. Additional Terms

8.1 Non-Disparagement Clause: Participants agree not to make any defamatory or disparaging remarks about Baila Vancouver Dance Inc. or Nina Perez Enterprises, its instructors, or its services in any public or private forum.

8.2 Force Majeure: Neither Baila Vancouver Dance Inc.  and Nina Perez Enterprises, or Nina Perez herself,  nor its participants will be held liable for non-performance caused by events beyond their control, such as natural disasters, pandemics, or government restrictions.

8.3 Limitation of Liability: Baila Vancouver Dance Inc. and Nina Perez Enterprises will not be held liable for any indirect, consequential, or special damages arising from participation in activities. Liability is limited to the amount paid by the participant for the specific service.

8.4 Confidentiality for Private Lessons and Coaching clients: Feedback or discussions during private lessons remain confidential. If the studio shares stories or experiences related to a student for marketing or educational purposes, it will be done in a way that protects the student’s privacy and anonymity.

8.5 Dispute Resolution: In the event of a dispute, both parties agree to engage in mediation before pursuing legal action. The successful party in any legal proceedings will be entitled to reasonable legal fees.

8.6 Severability Clause: If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue to be fully effective.

8.7 Entire Agreement: These terms constitute the entire agreement between Baila Vancouver Dance Inc.  and Nina Perez Enterprises, and participants, superseding any prior agreements or understandings.


9. Privacy and Communication

9.1 Email Communications: By providing my email address, I agree to receive communications from Baila Vancouver Dance Inc., and Nina Perez Enterprises, including class updates, promotional offers, and newsletters. Emails may be sent from nina@dancetoday.fun or hello@ninaperez.ca. I may unsubscribe at any time by following the link in the email or contacting us directly.

9.2 Personal Data: All personal information is managed in accordance with our Privacy Policy.
